Following international positioning, Law no. 14.460/2022 transformed the ANPD into an Autarchy. In the original wording of the LGPD (article 55-A, paragraphs and 2), the agency was framed only as a federal public administration body.
Law no. 14.460/2022 is a result of the conversion of Provisional Measure 1.124/22, approved at the end of October by the Senate. The transformation aims to prevent the administrative discontinuity of the ANPD, bringing more credibility to the data protection regulatory system.
